Debt Collection Law
Debt Collection Law is federal law which regulates the
activities of those who regularly collect debts from others. Many
states have adopted similar laws regulating the practices of debt
collectors.
What Is the Fair Debt Collection Practices Act
The Fair Debt Collection Practices Act was passed in response to
abusive conduct by collection agencies, resulting in an increase in
the filings of personal bankruptcies due to abuse. The purpose of
the Act is to provide guidelines for collection agencies which are
seeking to collect legitimate debts while providing protections and
remedies for debtors. The FDCPA applies to personal, family, and
household debts, including debts associated with the purchase of a
car, for medical care, for retail financing, for first and second
mortgages, and for money owed on credit card accounts. In-house
collection agents are not ordinarily covered by the Act. But if you
contact an ouside agency to collect your debt then the outside
agency 's conduct is restricted by the FDCPA
The FDCPA restricts debt collectors from engaging in conduct
including the following:
1. Collectors usually are prohibited from contacting such
permissible third parties more than once.
2. Making repeated telephone calls or telephone calls at
unreasonable times and use obscenity, racial slurs or insults.
3. Debt collectors should not harass, oppress or abuse any
person ,harm the person, property or reputation who refuse to pay
their debts
4. Debt collectors should not use any false statements like
they are attorneys or government representatives , misrepresent the
amount of your debt when collecting a debt or indicate that send
papers are legal forms when they are not.
5. Debt collectors also may not state that: you will be
arrested or will seize, garnish, attach, or sell your property or
wages if you do not pay your debt.
